For the purpose of this document :
‘The Photographer’ refers to Saira Awan or Sai of Sai Photography. In some instances Sai will have assistants or other photographers working on her behalf. All of these people fall under this heading.
‘The Client’ refers to visitors of this site along with any individual or organisation/corporate company that decide to employ the photographer on a freelance basis.
‘Image’ and ‘Photographs’ means all photographic material furnished by the photographer, whether transparencies, negatives, prints or any other type of physical or electronic material.
‘Shoot’ refers to the actual taking of the photographs, whether this be in a studio or on location (indoor or outdoors).
1.The entire copyright in/of the photographs on this site are retained by the photographer (Saira Awan of SAI Photography) at all times through the world. They may not be used without permission. 1.b.There fore the client may not download, reproduce, copy, store, manipulate, project, use or alter in any way, alone or with any other material, or by use of computer or other electronic means with the express written permission of the photogfrapher.
1.c.By entering the site you are agreeing to be bound by the terms of this agreement. Entrance to this sitre is expressly on these conditions.
1.d.No images are within the public domain.
2.Clients employing the photographer on a freelance basis will receive images on a licence basis, agreed before shoot takes place.
2.b.If no licence is discussed or agreed prior to shoot, due to unforeseen circumstances eg last minute shoot, then client will be informed of licence by photographer on handover of images (normally 6 months-uk rights).
2.c.The images will be licensed depending on intended usage of images and length of usage.
3.Payment by the client will be expected for the commissioned work within 30 days of the relevant invoice. If the invoice is not paid, in full, within 30 days the photographer reserves the right to charge interest at the rate described by the Late Payment of Commercial Debt (interest) Act 1998 from the date payment was due until the date the payment in made.
4. Images will be sent either in digital format (online), digital format (cd or dvd) or printed version (prints, album, photobook etc.) depended on pre agreed format by photographer and client.
4.b Client is asked to confirm receipt of images once received.
4.c photographer must be advised of any problems with images within 24 hours of receipt otherwise images will not be resent.
5. All attendees present at bookings are automatically assumed to be in agreement with a standard model release, whether a release is physically signed or not. No customer can revoke their model release at anytime based upon their changed preferences.
